Question:What is the ruling on lending Khums funds?
Answer:In the name of Allah, it is not permissible without the permission of the religious authority. Allah knows best.
Question:Is it obligatory for the guardian of a child to pay Khums on what remains from the child's gifts, rewards, and allowances?
Answer:In the name of Allah, as long as the child is not yet of age, Khums is not obligatory on them, no matter how much their wealth increases. Allah knows best.
Question:Is Khums applicable to gifts and donations received from parents, relatives, or friends on occasions such as marriage and others?
Answer:In the name of Allah, if the gift is used before the end of your Khums year, then there is no Khums on it. However, if it remains unused or any part of it remains, then Khums must be paid on it at the end of your Khums year. Allah knows best.
Question:Is Khums obligatory on inheritance?
Answer:In the name of Allah, if the deceased was committed to paying Khums, then there is no Khums on the inherited wealth. However, if the deceased was not committed to Khums, then Khums must be paid on the inherited amount. Allah knows best.
Question:Is Khums applicable to a person who is in debt for purchasing a suitable residence and is paying off the loan in installments over many years?
Answer:In the name of Allah, any money you possess at the end of your Khums year must be subject to Khums. However, if you pay it to the lender before your Khums year ends, then Khums is not required on that amount. Allah knows best.
Question:Many companies offer savings services to employees through a contract that typically follows this structure: The employee allows the company to deduct a percentage of their monthly salary, for example, 3%, before the salary is deposited into their bank account. The company then adds an equivalent percentage (3%) and invests the total 6% in various global stock markets on behalf of the employees. In return, after approximately thirty years, the employee receives a substantial accumulated amount from the monthly 6% contributions and the generated profits. The contract stipulates that the employee cannot withdraw the funds during this period; otherwise, they will lose a significant portion of their savings. How should Khums be calculated on these three amounts? 1.The amount deducted from the salary before being deposited into the bank account? 2.The amount added by the company to the savings account? 3.The profits generated from investing these amounts over thirty years?
Answer:In the name of Allah, Khums becomes obligatory on the total amount when the employee or their agent receives it, covering all three categories. Allah knows best.
Question:When does Khums become applicable to the surplus of the monthly salary if it remains in the bank account at the end of the Khums year?
Answer:In the name of Allah, if you are able to withdraw all or part of it whenever you wish, and you personally designated the bank to receive the transfer, then Khums is obligatory. Allah knows best.
Question:I am a wage earner who works hourly for a company and receives my salary at the end of each month. This salary constitutes my daily sustenance. 1.Is khums obligatory for a wage earner? 2.Is khums applicable to this income? 3.If I set aside a portion of my daily sustenance to save for purchasing a house, knowing that this saving will involve austerity for myself and my family for ten years, is khums obligatory on this money? 4.If I receive my salary one day before the end of my khums year, is khums due on it?
Answer:In the name of Allah, be advised, my dear, that anything that remains after covering your own and your family’s sustenance is subject to khums, even if the surplus is due to frugality or austerity. You must set a specific date for your khums year and commit to paying it on the appointed day for the khums of your income. Allah knows best.
Question:There are some institutions that are legally bound that whoever works for them at the beginning of his work is given a salary of (3) months in advance, even though he has not worked for them yet. The question: If the beginning of his Khums-year comes after a month, for example, and the money is still with him, is he obligated to take Khums in full, or only from the salary of the first month for which he worked? Is it the same ruling, if the employers paid in advance without an obligating law?
Answer:In the name Allah, be advised, my son, that the wage-earner owns the wages as soon as the contract is made, and he becomes required to work. What the hired employee took as in the question is his property. Therefore, he must pay the Khums in full and everything that is under his hand when the Khums year comes, whether it is from the salary or elsewhere. Allah knows best.
Question:We are aware that Khums is a mandatory not a recommended act the time of the Messenger (PBUH&HF) and the Infallible Imams (PBUT). However, what is the evidence that Khums continues to be mandatory after the second disciple of the Awaited Imam (may Allah hasten his reappearance)? Is there any saying by the Awaited Imam (may Allah hasten his reappearance) supporting the mandatory act of Khums after the second disciple? Are there authentic narrations proving this mandatory act, because there are many authentic narrations saying that Khums is not obligatory after the second disciple? Such books are by the eminent Shiite scholars like Sheikh Sadooq, Sheikh Mufeed and others. Kindly, clarify in detailed evidence the reality of such an issue.
Answer:In the name of Allah, first, my son, the Quran indicates the obligation of Khums. Any narration which contradicts Quran, we leave it, return it to its narrators and do not work according to it because it is contradictory to Quran. The Infallible Imams (PBUT) ordered to reject any narration that contradicts Allah’s book. Additionally, the narrations in which the nonprofessional thinks that Khums is not mandatory have certain contexts that are only understood by the people in know who are in the degree of mujtahid. These contexts indicate that some of the narrations say that Khums is permissible to certain people or at certain times or the narration is poorly authenticated. If you were from the people in the know, you should have not missed such things. You may review the research of Khums in Al-Jawahir, Al-Tanqeeh, Al-Mustamsak and other books in order to find what you are looking for, Inshallah.
